1. Introduction

Welcome to QuietRiverMarket ("us," "our," or "we"). These Terms & Conditions ("Terms") preside over your usage of our yacht hiring service and website located at quietrivermarket.site (the "Service") managed by QuietRiverMarket.

By securing a reservation or using our Service, you consent to be legally bound by these Terms. Should you object to any portion of these terms, then you are prohibited from using the Service.

2. Service Overview

QuietRiverMarket offers luxurious yacht hiring solutions, inclusive of, but not limited to:

• Yacht rental for the day
• Evening sea tours
• Business retreats
• Exclusive functions
• Extended sailing trips

All offerings are dependent on availability and climatic conditions. We hold the authority to alter or cease services without prior notification.

3. Booking and Reservations

3.1 Reservation Process

In order to make a reservation, you must:

• Be of 18 years or older
• Provide truthful and accurate details
• Remit the necessary advance payment as specified in your booking confirmation
• Agree to these Terms & Conditions

3.2 Reservation Confirmation

Your reservation is considered confirmed solely after the payment is made and our written confirmation is issued. We maintain the right to decline service to anyone at our discretion.

3.3 Reservation Availability

All bookings are subject to the availability of vessels and favorable weather conditions. We strive to accommodate your requests for specific dates and timings as best as possible.

4. Payment Terms

4.1 Pricing

All pricing details are indicated in € and include all relevant taxes, except as otherwise noted. Pricing is subject to modification without prior announcement.

4.2 Payment Schedule

• Deposit: 50% of the total cost of the charter required at the time of booking
• Final Payment: Due 48 hours before the departure of your yacht charter
• Incidental Expenses (if any): Payable after the charter concludes

4.3 Methods of Payment

We accept most major credit cards, electronic funds transfers, and certified bank drafts. All transactions are securely processed using encrypted methods.

5. Cancellation and Refund Policy

5.1 Customer-Initiated Cancellations

• Over 72 hours before departure: Complete reimbursement excluding transaction fees
• Between 24 to 72 hours before departure: 50% of the charter cost is refundable
• Under 24 hours prior to departure: Non-refundable

5.2 Cancellations Due to Weather

In case our captain determines the weather conditions to be unsafe, you will be offered the following options:

• Reschedule your yacht charter to a future available date with no extra charge
• Receive a full refund if it is not possible to reschedule

5.3 Cancellations Due to Mechanical Failures

If your designated vessel experiences mechanical issues, we will attempt to offer an appropriate substitute. If no replacement is available, a complete refund will be granted.

6. Safety and Conduct

6.1 Safety Protocols

All attendees must:

• Heed all instructions provided by the crew
• Don safety gear as needed
• Disclose any medical conditions that could influence their safety
• Stay within assigned areas onboard

6.2 Restricted Items

Prohibited items that cannot be brought onboard include:

• Glassware
• Banned substances
• Weapons of any kind
• Excessive amounts of non-alcoholic beverages (beyond a reasonable quantity for consumption)
• Pets (unless approval is obtained beforehand)

6.3 Behaviour

Guests must maintain respectful conduct at all times. We reserve the authority to terminate a charter without a refund if a guest's conduct is deemed dangerous or disrupts the experience for others.

7. Liability and Insurance

7.1 Our Responsibility

Our liability is solely confined to the payment you made for the charter. We hold no responsibility for:

• Injuries sustained due to passenger carelessness
• The loss or damage of personal belongings
• Indirect or punitive damages or losses
• Delays resulting from weather or situations beyond our control

7.2 Coverage of Insurance

Comprehensive marine insurance is maintained to protect both our vessels and operations. However, we recommend passengers take care of their personal and travel insurance needs.

7.3 Risk Acknowledgment

Engaging in our yacht services implies that you understand the inherent risks associated with marine activities and accept responsibility for your personal safety and security.

8. Modifications and Itinerary Adjustments

We retain the right to alter itineraries, courses, or timetables in response to meteorological challenges, safety requirements, or operational demands. We will aim to offer equivalent alternatives wherever feasible.

9. Force Majeure

We bear no liability for any postponements, cancellations, or changes stemming from events outside our sphere of influence, including, but not restricted to:

• Intense meteorological phenomena
• Calamities of natural origin
• Directives from government bodies
• Harbor shutdowns
• Equipment-related technical issues

10. Privacy and Personal Data Protection

Your private data is managed as per our Privacy Policy. By patronizing our services, you consent to the aggregation and application of your data in the manner delineated in the Privacy Policy.

11. Intellectual Property

All content available on our website, including but not limited to, written copy, imagery, brand symbols, and designs, is subject to copyright and trademark protections. Unauthorized reproduction, dissemination, or the crafting of derivative works without our explicit consent is prohibited.
